If I get a linux-2.6.18.tar.bz2, drop all copyrigt notices and licenses, rename it to xunil-2.6.18.tar.bz2 and sell as a proprietary product, it IS the proprietary product. While it is obviously copyright infringement and 2000 developers going to sue me, it is still the proprietary product until I (voluntarily or by court's decision) release it under open-source license.

No, it's different beast. However there are many devices with the same hardware as Hanlin V3, but with different firmware: http://openinkpot.org/wiki/HanlinV3, you may want to try one.

They will indeed - but do you have a licence to run it if you haven't bought a CyBook? I could make a copy of my Windows XP CD and give it to you. That's fine - you're only breaching copyright if you run the software.

You can only violate the license if Bookeen tell you what it is. If they don't send one with the firmware, then there is no license to violate.
