Why on Earth would anyone pay for a demo device that it would be illegal to reflash?

HarryT, even before I became a member here, I was reading about people buying bulk lots of damaged or demo Kindles and "repairing" them. Truthfully, I didn't even think about the legality. I figured with the forum policies on DRM and... (blank look) ... ah. special offers that there would be policies against replacing the OS, too.

True, I guess you could install a different o/s on it.

Because you wouldn't have a licence to run the standard Kindle firmware on it. Reflashing it with the standard firmware would be copyright infringement. You could certainly install a standard Linux distro on it, but not copyrighted software like Amazon's firmware.

Are you saying that where you live you could build a PC, borrow a friend's Windows installation DVD, and install a copy of Windows on your PC without a software licence? That's exactly the same situation as we're talking about here.

However in this case demo Kindle has it's own licence (serial number) and reflashing it does not alter the part holds this info. In other words you can borrow your friend's installation DVD as long as you have your own serial.

But it doesn't - that's my point. A demo Kindle is not licensed to run the standard firmware. The serial number has nothing to do with it.
Don't take my word for it, though. Ask Amazon. |

What is being used is the **SIGNED** firmware image posted by Amazon for the use of Kindle owners. Which, after use, allows the Kindle to be registered with Amazon. If it where "illegal" - then: 1) Amazon would not allow the "Demo" devices to install anything that wasn't signed with a "Demo Only Certificate". (Or to install anything that was signed by the retail user certificate.) 2) The serial number of the device would be black-listed in their system so that it could not be registered to the new owner. What **might** be a contract violation, the **sale** of a Demo Kindle by the holder of the Kindle Demonstration contract. But that contract is not between the new owner and Amazon. That is between Amazon and their Dealer(s). N.O.P. In the U.K., the situation may be different. |
