It is absurd to you. But it is a little presumptuous to use the word "we" above. Here is a web site discussing the intellectual property rights of innovative chefs:

Preparing patent applications on food recipes that will have a strong chance of succeeding can be a little tricky. No matter how tasty the dish or how much people rave about it, your recipe must still meet the basic conditions of patentability all other inventions must meet: The recipe must be useful, novel and non-obvious.

The explanation of the recipe, such as in a cookbook, can be copyrighted. The recipe itself can be potentially patented as explained above.

I am not sure that the cake is copyrighted, but rather the name of the cake? Similar to a title on a book?

Interesting that people seem to want to patent recipes rather than copyright them. But why can't recipes be copyrighted? Or are they? They are certainly an expression of an idea, whatever that means. If someone wants to try and define what an idea is please feel free.

There are certainly many novel techniques with regard to the production of foodstuffs, are you suggesting that if a chef comes up with a novel method of producing a highly nutritious food in an efficient manner that home cooks should not be allowed to copy this chef, else they infringe the chefs IP?

It depends on whether the technique is currently under patent protection and how you found out about the recipe. If you downloaded the cookbook from a pirate site, yes, you infringed against whomever currently owns the IP, which could indeed be one of your fellow chefs.

For a concrete example that I've been meaning to try for years:

The Secret of Great Bread: Let Time Do the Work

and

Recipe: No-Knead Bread

It's nice that everyone involved in the above links, from the bakers to the New York Times Company, let us in on the new technique without charging us. But we should respect their decision if they had gone another way.

Suppose that chefs couldn't make money by writing copyrighted cookbooks. They would then have more reason to keep their recipes secret, or to patent them. So you have given me a new reason to favor mildly stronger copyright protection -- encouraging chefs to publicize their best recipes.

You so much want to look up the difference between copyright and patent.

Oh it's been done already and it's even PD. You so much want to look up Plato. The greek philosopher that is.

That's a US perversion being far from worldwide acceptance

Giggles:

You really need to read more and increase your understanding before posting. Copyright, patent, and trademark are all different forms of intellectual property (but not the only forms). They have different uses and exist under different terms.

Without resorting to piracy, you can increase your understanding by reading:

http://en.wikipedia.org/wiki/Patent
http://en.wikipedia.org/wiki/Trademark

Oh well, empty vessels...

Ain't it a pity to have to assign reading to somebody who demanded access to knowledge so vocally?
Ah, I remember again. He just called it so, whilst meaning entertainment.

Copying anything that you have legally purchased, eBook, software, music, etc., is not piracy where I live. Distributing it would be considered piracy. If it were otherwise, iPods and the like would be illegal. As would organisations like 1dollar.

Giggleton's views on piracy are more intellectually challenging than the typical ones you see from piracy apologists, because of his effort to keep pointing us back to first principles. It's more popular to make blame-the-victim arguments against entertainment industry fatcats.

SteveI am not quite sure what you read because I don't qualify unreflected wanna-be-communistic juggling with terms like: economy, copyright, patent, etc. without having the slightest idea of what they actually mean as "intellectually challenging" The only things Giggleton manages to challenge are sanity and patience.
