I too think that something needs to be done to protect some form of copyright (just not this one, as it's way out of control, but that's a side issue). But not by prosecuting domestic copyright violators with these out-of-control claims...

The biggest reasons why they're not prosecuting now, and instead doing lawsuits, is that it is WAY easier to win a civil suit on this sort of thing instead of criminal case, and they can get more money this way. If they tried the same tactics for a criminal case, the cases would be thrown out of court.

Well, there's always the old standby of putting watermark footers into PDFs, or inserting a "This ebook compiled for..." line at the end of an ePub. If you find ebooks from them on torrent sites, you proceed to baninate individual accounts.

Its also a system that's fairly unobtrusive to the reader.
