Yes, I got arrested for photographing a police woman once. Of course, she was in the shower and I was up a tree in her garden with a tele-photo lens..

It was an ordinary building. And he wasn't taking a photo of the building. He was taking a photo of his family in NYC. The building just happened to be in the background! But one of the offices of that building was used by a Federal agency. THAT is what caused the problems.
