Kobo left uncharged for long?

Well, I'm planning to sell my brand new unused Kobo because I have another ereader. But, I opened it when the package came in just to check if the lcd didn't get damaged from shipping. As far as i know, it's working fine.

Now, it's been a little over a week and I opened it again, just to check, and I saw that the battery is like around 5-10%.

My question is, would the device be damaged or something if i left it uncharged for long? I don't want to have to touch it, since I'm saying it's brand new and unused.

Thanks.

If you didn't do an initial charge when you opened it, it has only the charge it shipped with--not anywhere near a full charge.

Yes, but since I opened it, I was thinking that even if it is powered off, the battery is still being used up. Am I right?

I don't see any problem if the battery runs down. It's no different than Kobos that sit in a warehouse inventory for long periods of time before being shipped or sold. This is why they instruct you to first charge the unit after opening because the battery may be completely discharged.

Can't you return it? I think there's a 30 day return policy...

Why? The battery has never been charged--nothing to indicate that it is defective.
