This might have something to do with the patents that Apple recently acquired.

This one in particular:
Quote:
Apple Receives a Granted Patent for the iMac's Edge-to-Edge Glass Cover

Apple has been granted a patent for the iMac's eventual advancement to an edge-to-edge Glass Cover solution. This particular iMac form factor debuted in 2005 in plastic and its glass cover didn't go edge-to-edge. Neither did their 2008 aluminum iMac. It was Apple's fall 2010 iMac (see Step 5) that finally delivered the new edge-to-edge glass cover which adds so much to the iMac's classiness.
And if anybody understands lawyer speak, from the patent:
Quote:
What is claimed is:

1. A display cover to metal housing interface system, comprising: a translucent or transparent display cover adapted to be placed proximate to a display screen such that said display screen is visible through a viewing portion thereof, said display cover having a front face, an obverse face and a distal edge portion between said front and obverse faces and around a circumference thereof; a metal housing adapted to house the display screen and provide stabilized support for said display cover while said display cover is placed proximate to the display screen, wherein said stabilized support comprises a force interaction between one or more distal edges of said metal housing and said obverse face of the display cover, such that at least a portion of said display cover distal edge portion is fully exposed to outside of said system while such stabilized support is provided; a protective layer situated between said one or more distal edges of said metal housing and said obverse face of the display cover, said protective layer being adapted to prevent or reduce damage resulting from said metal housing contacting said display cover; one or more support components adapted to hold said display cover in place with respect to said metal housing, said one or more support components restricting relative movement of the display cover in a direction substantially perpendicular to said front face; and a stabilizer assembly affixed to and along an outer edge of said display cover, said stabilizer assembly being adapted to couple to at least a portion of said metal housing such that relative side-to-side movement between the display cover and the metal housing is restricted.

You couldn't open a book by turning pages with your hands. Imagine the trouble of reading the entire book if you didn't pay the page turning by hands license fee

Apple and its lawyers have, perhaps inadvertently, misled the judge of a Düsseldorf court by filing flawed evidence of the similarity between the iPad 2 and Samsung's Galaxy Tab 10.1 tablets based on an inaccurate picture, an investigation by Webwereld.nl, a Dutch IDG publication, has found.

Quote:
Arnout Groen, a lawyer with the Dutch firm Klos Morel Vos & Schaap, specialized in intellectual property rights litigation, is baffled. "This is a blunder. That such a 'mistake' is made in a case about design rights can scarcely be a coincidence. ... The aspect ratio of the alleged Galaxy Tab is clearly distorted to match the iPad more closely. Inasmuch as this faux pas will have consequences for the case is of course up to the judge. But at least a reprimand by the German judge seems to be in order."

The PC mag article is just linkbait. Look at the petition I linked to - there are a lot of other pictures in there showing the different sizes and aspect ratios of the two devices, and none of the specific claims in the petition are based on a claim of identical size or aspect ratio.

Is good faith required in Europe, or is that a concept only important in the USA?
If it is a purely US concept, you have a point. But only in that case.

I suspect the court based their decision on evidence other than photos provided by Apple. Just a guess, though.

When did the US change?? Apart from the fact that this thread is talking about a lawsuit and US lawyers are just the same as any others... facts are entirely irrelevant to winning a case...

Galaxy Tab 10.1 still on sale in Germany

I've been in half a dozen telecom stores in Dusseldorf today.
Samsung Galaxy Tab 10.1 still is on sale.
I've asked the Vodafone sales staff: "That's only our remaining stock. We're allowed to sell them, but then we're done (for now)".
They didn't tell. But from their behaviour, my guess would be, it doesn't sell very well anyway.
I guess, Germany is kind of an Apple highground. Maybe there's a good reason, why Apple chose Germany for the legal actions?
