I know many say to get the Sony for library only books and the Kindle for newer, but I have downloaded a few new bestsellers from Sony and the whole process from top to bottom was a piece of cake and not any difference in book price. If I had opted for the Kindle, the up-front cost would be $100 more.

I'm sure they are both excellent and like you I took a long time to decide between the two. I even had buyer's remorse and thought about returning the Sony 505 for a Kindle when I saw a few on Twitter loving their Kindle, but now I am very happy and do not care if I have the same ebook reader as Demi or not!

Here in the UK you can generally only return something if it's faulty, not merely because you don't like it .
Yup, I'm familiar with the UK policies (lived there for years) and I found I managed to talk stores into returns. Anyway, when I did my return I made sure I showed the clerk that everything was there and in perfect condition. The clerk put a sticker on it with a reduced price as I guess they cannot sell as new, but they kicker was that the used priced, although discounted from the original price, was still more than their in-store price last weekend.

Well, it's down to the individual stores, the same as in the US - for instance, John Lewis's policy is "we will be happy to refund or exchange a product provided it is in fully resaleable condition. Returns should be made within a reasonable time (usually 28 days) and in original, undamaged packaging".

It's possibly taken advantage of less than in the US, but in certain sectors, clothing being the one that springs to mind, it's usual practice over here too.

For me it depends on what books you wanted to read. If most of the books can be read more in the Kindle than in the Sony then grab for it. But I love my Sony due to its versatility and most of the books I like can be read on the Sony.

Fry's sells them as a opened box with a discount.

Look closely though if you go to Fry's cause at the moment their brand NIB is cheaper than the discounted opened box price.
