Digitizer half-dead on ebayed Iliad :(

Hi!
Bought a 1st gen Iliad off eBay, and sure enough, got one with a broken digitizer

The problem manifests itself by pen not being tracked on ~half of the screen.
The non tracking areas are wide stripes.
I've illustrated it in the attached notes picture

The problem is that half of the interface cannot be used, like the bloody keyboard. Can't type keys QAZOP, and even worse, can't type the dot, so no way to connect to IDS.
I was thinking of flashing it and see if it help, but I see no way to do that without typing the email/pass

The rest of the Iliad seems to be working fine.
Any ideas?
I still have a week to file a claim.

It's almost without question a hardware problem, so reflashing won't help. I'd suggest contacting the seller and requesting a refund.

Yeah I figured as much, but had to ask.
Tried my tablet pc pen on the Iliad with the same results.
In the case I get stuck with it, could you recommend a way to skirt the keyboard problem? I was thinking copy-pasting, but I'm unsure there is such functionality?

Got a reply from the seller, no refund. Says I didn't ask if the digitizer was working.
I've never heard a thing about broken digitizers on Iliad (I did google).

What a sad story!

There's a button on the keyboard that says 'Move up' (next to Shift). When you press that, the keyboard moves to the top of the display. Maybe it will enable you to reach some more keys...

You didn't have to ask about if it's broken.

The item you bought is simply not the one advertised. Contact eBay.

I don't know where do you live but some countries have 'special' laws regarding Internet/Mail-Order/Phone transactions. They let you return the product within for instance 10 days without reason for a full refund.

I agree with this. If they said it was in working order, you have a case.

Tried that, but it only allowed me to reach two more letters, still no dot, so can type the email address.

Switching the interface to landscape, could help, but I see no way of doing that.

Ah, they advertised that it powered up and loaded ebooks fine, cosmetically perfect, screen good. He did offer to do tests, but it really has not occurred to me to ask about the digitizer, as it's not a fail prone component and it would be should be noticeable that it's faulty

A lot of times they'll say things like "sold as is" or that they make no guarantee as to the working condition because they honestly don't know the condition. However, it certainly sounds like this seller KNEW it was broken ahead of time. I don't know if there's any legal recourse for a seller knowing an item is broken, but not saying so in the description. It's certainly unethical, but it may be legal.

You could easily argue that they said the screen was good, and the digitizer is part of the screen. Based on the tone of their other response though, it doesn't sound like they're going to do anything unless you get a third party involved, like Ebay or your credit card company, etc.

You shouldn't have to ask if it's working - there is a reasonable expectation that any goods sold are in working order, unless stated otherwise. I'd suggest that you instigate a complaint with eBay. If you paid by PayPal, I believe that your payment should be protected.
