Actually, I have to agree with Harry and disagree with you here. In addition to his points we actually have a lot of instances where certain degrees of punishment are carried out on those that haven't gone to trial.

The most common is seizure of properties. These happen quite often in supposed drug, 'digital' or RICO crimes. Police departments and other agencies have a habit of auctioning off any materials or properties that are confiscated that are not considered evidence prior to even going to trial. Having seen this behaviour first hand I can report to you that my friend's lawyer, who I was a witness for, stated that he was better off writing off what he had lost then trying to claim it. Similarly if you are ever 'caught' with a large sum of money, police have a habit of confiscating that as well with -no- defined reason (the logic of course that only drug dealers would have so much cash on hand, or perhaps those wary of U.S. banks?). If you are lucky enough to get your money back, expect to spend a year or two fighting for it.

Adopted this morning by the Senate, the text has just been REJECTED by the National Assembly, with 21 votes against, 15 votes in favour, after nearly 2 hours of discussion.

of course, the government *can* re-submit the law again, or it will be completely withdrawn. however, if it is resubmitted, it would have to be accepted with no modifications, and that looks highly unlikely, since even some members of the majority government have voted against it, Jean Dionis du Séjour and Nicolas Dupont-Aignan.

we'll have to wait and see how things go but this is an encouraging sign for democracy and civil rights indeed.

Don't you find it a little discouraging - from the viewpoint of democracy, I mean - that something this important should be accepted or rejected by 36 people in the name of the - what? 70 odd million people? - in France? Accept it or reject it, it's not really a shining example of "democracy in action", is it? Anyway, I'm happy for you that you have the outcome that you wanted.

i was a lot more worried when it was accepted by a vote of only 16 députés, which didn't seem to bother you.
