I never had a doubt. The Supreme Court does not take up new issues raised on appeal (Amazon made me do it).

Whatever. It's over. And that "minority" (if I remember correctly) didn't deny that Apple colluded with the publishers, he just bought into their argument that the end justifies the means -- that Amazon had to be knocked down a few pegs because they had too much of the market.
