I wonder if the encryption decision applies at time of purchase, or at time of download. It's been described here as time of purchase, but if I understand the process correctly, the decision is made at the beginning of the download, based on the client.

B&N and Amazon occasionally put updated versions of already-purchased books in your online account. And I occasionally check for and download new versions of books I already purchased, in the hope of finding errors corrected and/or improved formatting.

I've only bought a few books from Google, Kobo, etc., so I don't know if you can "re-download" previously purchased books using standard Adobe DRM.

I can see a company wanting to "close the loophole" of previously purchased books using easily-defeated DRM, and so upgrading the encryption if a new copy is downloaded.

Downloading. During purchase the server have no clue about your adobe ID.

If that was the goal, ADE 3.0 could have "upgraded" the encryption of the books you already have, at the time you installed it. The ADE software knows how to decrypt both DRM schemes, so it could decrypt the old and re-encrypt with the new method.

That's what I expected when they announced new DRM, but I also expected that it was customer friendly enough to do the same thing in the other direction (produce a copy with OLD DRM) when exporting a book to a device that does not support the new DRM yet.

If instead anyone who buys an ereader today and downloads ADE today (and ends up with ADE 3.0 because that's what's being offered now) and happens to buy a book at the wrong place (you can't tell beforehand which version you'll get), that's a great start into ereading when they can't actually read it on their device at all...

No, just a note of what encryption has been used.

The Content Server already has an (unencypted) copy of all the books it handles, and a note of the Adobe ID used for all books bought from the server - that's why you can't use the same .acsm file on two different accounts. The server knows that the .acsm has already been used, and what Adobe ID was used to redeem it. Adding in a flag for ADE 2 or ADE 3 encryption is trivial, and probably essential just to support ADE 3 encryption at all.

Ok, that make sense. We know that adobe keeps track of download ie the "book already licensed to an other user" and "Download limit exceeded" messages.

I'm confused about one thing though and I'm hoping someone can explain it. I only buy Adobe epubs from Kobo, I haven't authorised my device with Adobe, and it shows as Not Authorised in the device account settings, yet I can open an Adobe DRM epub directly on the device. How come?

Are you sure you are reading the Adobe DRM epub version and not the Kobo DRM kepub version of the book?

When you buy a DRM epub book at Kobo you can either download the book directly to your Kobo device, in which case you get a kepub format book with Kobo DRM, or you can download an Adobe DRM epub to your PC and sideload it to your device, in which case you get an epub with Adobe DRM. (You can do both if you wish).

Kobo DRM is different to Adobe DRM, you don't need an Adobe ID or to authorize your device with ADE to read books that hae Kobo DRM.

It's the kobo download I'm getting. I'd never side load an Adobe DRM ePub directly to my device. That's good news as it means I'm unlikely to hit any issues going forward unless I am forced to upgrade my ADE to 3 or ADE 2 suddenly refuses to open a Kobo download.

If that happens I'll simply stop buying from kobo.

Thanks for the explanation btw, I really don't get Adobe DRM tbh,

Same here. I downloaded the EPUB version of a book I bought yesterday from Kobo with ADE 3 and imported it in Calibre. Alf still did his magic without a hitch.
