Apple Sues Polish Grocery Store Over A.pl Name

Two weeks before unveiling its next-generation iPhone, Apple was busy filing a lawsuit against Polish grocery site A.pl.

As reported by Polish news outlet Telepolis, Apple is railing against the online deli site because its title is just a little too reminiscent of the Cupertino-based company's moniker.

A.pl, which advertises straight-to-your-door delivery, goes by the full name A.PL Internet SA. While ".pl" is actually Poland's country-wide domain, Apple is arguing a trademark issue, demanding that the Polish Patent Office cancel the site's trademark. The main allegations, according to Telepolis, are the likeness of characters, and "the use of Apple's reputation," the site said.

I agree they have many satisfied customers and shouldn't over-tinker. (I love my nano(s), and am really tempted by the new one.)

It's there tendency to not just focus on that, but to say (to beat an analogy to death): "We make the best Apple pies that customers want and love. However, you cannot make apple pies that are: round, contain apples and sugar, are baked, or that are called 'apple pies'." That's what bugs me.

The basic version of Google's Android operating system displays a glow effect when a user reaches the end of a list. So, the firm could revise an adapted version used on Motorola devices to abandon their use of an added bounce-back feature.

However, he added that if Apple posted a bond of 25m euro ($32.6m; £20.1m), it could now force the devices off shop shelves, and for an additional sum it could have them destroyed or recalled.

It's not the legal fight over the patent that I find ridiculous, it's the disproportionate penalty available. Really, because a scrolling effect on a tablet device bounces back in a way patented by Apple, they have the power to get all unsold stock destroyed?
