This case has nothing whatsoever to do with the MPAA. The BPI brought this prosecution (which does not make them "the bad guys"; TBP are "the bad guys").

I should have left off the "here" since in this case the MPAA was not involved. I just meant in general that the MPAA and RIAA are the bad guys, in response to markbot...

Of course it makes BPI the bad guys since they are doing things that if not stopped will destroy the internet.

No, I think you'll find that it's the users of TPB who are the ones doing the "bad things", not the BPI.

Not at all. They are not destroying the internet. Instead they are using it in a certain way and are driving the further development of good stuff.

The BPI are "the bad guys" because they didn't go after TPB.

If you have a person committing crimes with a knife and the organization that supports the victims decides to go after the owner of the shop who sold the knife, I would say that they are doing something wrong.

For one thing, that isn't the only shop that sells knives, and for another, even if selling knives would be illegal, crimes could still be committed with other sharp objects. It doesn't solve any problems.

To make the knife store analogy a little more accurate you should change it to something like this.

The Pirate Bay is like a shop that sells knives and then tells you: "look, now take that knife to the second floor, they have a jewelry store there you can rob, we even provide a special back entrance for you. And nobody has ever been caught since they don't have surveillance video". You should add that the name of the store is 'Knives for Crimes', to keep out the cooks and other pesky customers.

To make the analogy even more fitting, you could say the store has a great number of monitors showing video links to places that are easy to rob.

No one here is denying the right to disagree with the ruling. But I'm pretty sure that the High Court of Justice, established in 1875, never upheld slavery. And its predecessor Court of King's Bench ruled in 1772, in the famous Somersett case, that there was not, and never had been, a legal basis for British slavery. Maybe you can show otherwise, but I doubt the court ever upheld slavery -- before 1772, the issue never came before it.

Undoubtedly there were other courts, notably in the Americas, that dismissed the pleas of bondsmen. Which has nothing to do with the quality of the court in question, or its rulings.

I personally don't see the point of blocking pirate bay at the ISP level, I simply use hma to bypass their restrictions.

The point is not to stop seasoned pirates (that is virtually impossible). To make another analogy, the point is to drive the sellers of bootlegged materials out of the store fronts on main street to a push cart in the back alley.

This will certainly curtail a lot of casual piracy but the harder core community will simply use a VPN to circumvent the ban or move to more "private" sharing sites.

There are many, many more sharing sites available even for casual file sharers. Boy and leaking dike stuff.

In reality, with all the loud bleatings and cries of impending doom of the music, entertainment and publishers front pieces, their annual profit continues to rise.

I am of the belief that all this "woe is us" whining is simply all rearguard actions to avoid actually making meaningful reforms so as to be relevant in today's digital economies.

Do you have any "evidence" to back this claim up? Because from the ever increasing amount of material that is being "pirated" It appears that piracy cannot be stopped, nor should it be.

Simply typing, "Why isn't pirate bay not working" into Google should get the casuals to the next site at any rate.
