Unless the image is protected by copyright or trademark (my avatar is protected by both), I do not see a problem. If you feel strongly about it, talk to the guy and I am sure you could come to an amicable resolution.

It's just courtesy to not use the same avatar as someone else on the same forum. It's not a matter of who owns the avatar image used. It's just being polite. Sure, once it's no longer in use then feel free to have at it. But it's just not a nice thing to do.

There is a thread on avatars and some have mentioned that they see the avatar before they see the user's name and know who it is based on the avatar before seeing the name. So using someone else's avatar can cause others to think what is being said is from someone else. Would you want others to mistake someone else as you?

If they're stupid enough to use only the avatar, and not a combination of avatar, user name, and signature, I'm not sure I care what they think about me.

Oh Jon, that is one ugly little penguin. I doubt you will have to worry about people using it in the same way as your old one. You are right, it would be a courtesy, maybe that is why the moderators are not willing to make this into a rule. We're all adults here, and being courteous is well, while not always the norm, not something that should have to be enforced with numerous heavy handed rules.

Exactly. So, that being the case, why do you keep changing your avatar? I find it a little strange that you complain about someone else using a particular image, and then change to a different image yourself?

Honestly, Jon, you don't have a leg to stand on here. This is not "your" image - you've taken it from somewhere else, and other people have the right to do exactly the same thing. If you want something that's truly personal to you, then CREATE something original yourself.

And speaking of avatars.. This current one is gross. Just stay with one Jon and I wouldn't have to re-block the image every couple of weeks.

If you'd stop blocking, maybe I'd stop changing. But in this case, I changed because this one fits for Halloween.

So basically, the moderators stand is that it's OK to be rude and steal the avatar of others on MR. So do the moderators not care if a user is going to be rude and do this?

It's only your interpretation that it's "rude", Jon. This is not something that we have any rules about. To repeat, if you want to guarantee uniqueness, create your own avatar. What's so hard about doing so? Just take a photograph of something that appeals to you, or draw something.
