Galaxy Tab Banned in Europe - Page 13

Right. I've gone back to the 44-page Apple document and taken another good look.

This is where I saw the Samsung box side-by-side with the Apple one, and it's the way both boxes are presented tilted that makes them look similar, emphasising the tilt of the Galaxy image. When I first saw this I was struck with the similarity. Having seen other photos at other angles they look more different.

More interestingly, I've measured the line drawings in the Apple document. They have an aspect ratio of 1.36 (close to, but not exactly the 1.33 of the iPad).

The controversial image of the Galaxy Tab that may have been 'accidentally stretched' when inserted in the document I make 1.4, but others have measured it at 1.36. Anyway, certainly closer to the line drawing's 1.36 than the true 1.6.

Others have pointed out that this isn't the only photo of the Tab in the document, and the others aren't distorted, which is true, but tellingly it is the only photo of the Tab in the document that is side-by-side with the iPad and which isn't taken at an angle (which lessens the effect of the aspect ratio difference).

I'm not sure what you mean by that, Rock.

The JooJoo was the rebadged CrunchPad and was developed quite publicly over a 2 year period, roughly paralleling the development of the iPad which was not seen until a month after the above photograph was taken.

For that matter, we could cast our minds back to the other protoypes that were shown at CES 2010 in early January 2010, before we got to see the iPad. For example, the Asus Touch:

I can't seem to lift out the image URL from that link, but the article again indicates that companies were intending to release tablets with the obvious flat design with black bezel and rounded corners even then, because it was an obvious design choice and the technology had improved to the point that it was possible.

There's no need for the quote marks. We all understand that we're mumbling on the sidelines.

However, can you explain to me why, when Apple's injunction revolves around Samsung having 'stolen' the iPad's trade dress, the JooJoo should not be used as an indication that the features highlighted by Apple (flat screen, black bezel, rounded corners, side ports), all of which appeared earlier in the JooJoo, were obvious choices in tablet design and should be available to all manufacturers.

Please don't say 'it's for the judges to decide'; that's taken as read. This is a forum discussion. What's your opinion?
