in one of the other suits filed by Apple it was found that the Apple lawyers violated copyright on the pictures they used. Instead of taking pictures themselves for their affidavits the lawyers searched for pictures on line and used ones they found on a blog- without asking for permission.

Did Apple hire another set of lawyers to sue these guys for incompetence?

I must admit, I never understood how a German judge could decide for all the other European countries...

I guess, Germany is kind of an Apple highground. Maybe there's a good reason, why Apple chose Germany for the legal actions?
The other way around. It is selling like crazy at Media Markt, which is the reason why they decided to brave the injunction and go on selling them (stock maybe, this was not said). The Media Markt sales VP explained (on TV yesterday evening) that the fine they will have to pay will be much lower than the turnaround they get out of the tab. He also said that Android Tablets in general were more in demand than the ipad.
How long will it be before Apple pulls out of Media Markt .... ?

According to TechCrunch, it's because "...The German court system tends to lean more on the side of the right holder than the alleged infringer, so Apple already knew it had a pretty good chance of winning the injunction." Source

Similarly, there is a tendency for English courts to favour equality and 50/50 settlements in divorce, so it's no surprise that London gets its fair share of high-profile divorce cases instigated by the estranged wives...

Seems that in love and war, you need to pick not only the battles, but also the battlegrounds.

Cheers, Pete

I've just had thought regarding this injunction. Wouldn't the original JooJoo tablet, which emerged from the Crunchpad debacle, match the images in the Apple document?

The JooJoo launched (just) before the iPad, and I would imagine that the years of Crunchpad development would parallel if not precede the development of the iPad.

(In related news, the JooJoo 2 is on the horizon.)

Or the fear is that if the device is banned, getting peripherals will be a real pain.

Actually the Wiki says development started July 2008 which may be some what later than the iPad development first started but not certain... however the first release of the device was after the release of the iPad (again from the same Wiki source in your link) as it quotes pre-orders increasing after the release of the iPad...

Samsung is alleged to have violated an EU directive, so generally the court of any EU country with appropriate jurisdiction can issue a ruling that is binding on the entire EU. (If that weren't the case, it would basically defeat the purpose of the EU, since you would have to sue in every separate member nation. *And* you would probably get conflicting rulings).

There is a good description of why the injunction was partially lifted here: http://fosspatents.blogspot.com/2011...ended-for.html.

I recommend reading the whole article, but the summary is that the German court clearly had jurisdiction over Samsung Germany, and there it no question that it can prohibit that entity from distributing Tabs in Germany and throughout Europe. But it is not clear that the court's jurisdiction over Samsung Germany gives it jurisdiction over Samsung Int'l - which is why the court lifted its injunction for the rest of Europe. It seems to be clear that an injunction filed in Spain would give the court jurisdiction over Samsung Int'l for all of Europe, though.

The JooJoo was actually released the week before the iPad, on sale and with pre-orders being fulfilled from 25 March 2010.

The comment you're referring to:

Quote:
On February 1, 2010, Fusion Garage CEO Chandrasekar Rathakrishnan announced that JooJoo pre-orders had increased following the debut of the Apple iPad
is to an increase in JooJoo pre-orders following Steve Jobs keynote announcement of the iPad, i.e. its debut on 27 January 2010, not its actual release. The iPad actually began to ship a week after the JooJoo shipped, on 3rd April 2010.

How is this company still able to distribute the JooJoo? I thought the original developer/creator was/did sue them over this?

Their new product (Grid) is totally new, they claim.

I believe their litigation over the CrunchPad/JooJoo with Mike Arrington of Techcrunch is still ongoing.
