The books in question might be, (though they shouldn't), but the kepub format itself does not mandate encryption. The only example I can get my hands on immediately are the help files included with the Kobo, which are kepub but not encrypted.

Ah but for instance... even the free books that came with Kobo Wifi and Kobo - 1, althjought they were all PD were encrypted.

Just updated my desktop software (with a "critical" update). I like the new look, but it will no longer sync with my nook color.

I dislike the new look, makes it harder for me to find things. It still syncs with my Sony 950 though.

That was strictly a desktop update, so it would have no impact on the Kobo Wifi itself. You'll have to wait for a firmware update for the Kobo Wifi to have any chance for more fonts (don't know if they plan to add more fonts/ability to custom add fonts to the Wifi firmware or not though).
