If you really get cracked screen and don't think it was caused by you I would suggest contacting local customer protection office (I take there is something like that in Spain too?) and ask their opinion and armed with that knowledge contact retailer. One thing I have learned that in EU actual contracts and papers signed with customer don't really mean much. There are lot of EU customer protection that can overrule any contract or written guarantee so that customer has more rights. |

Kameli, if you do not believe me (which you have the right to), you can go to lectoreselectronicos.com, where you'll hear endless tales of woe about how seemingly untouched screens were broken, and their warranty covering denied by the seller.

Logseman, I do believe sellers try to tell you it is not covered by warranty. However they are wrong.
I don't understand Spanish so I have bit hard time finding Spain specific info. If they refuse to repair broken screen you should probably contact "Instituto Nacional del Consumo". http://www.consumo-inc.es/ EDIT: With some google translation magic I believe I found the Spanish law covering this. http://civil.udg.es/normacivil/estat...act/L23-03.htm Artículo 9. Plazos. 1. El vendedor responde de las faltas de conformidad que se manifiesten en un plazo de dos años desde la entrega. En los bienes de segunda mano, el vendedor y el consumidor podrán pactar un plazo menor, que no podrá ser inferior a un año desde la entrega. Salvo prueba en contrario, se presumirá que las faltas de conformidad que se manifiesten en los seis meses posteriores a la entrega ya existían cuando la cosa se entregó, excepto cuando esta presunción sea incompatible con la naturaleza del bien o la índole de la falta de conformidad.
