Not to be overlooked, but unlimited ebook lending already exists. Just loan your Kindle to whoever you want and as many times as you want - just like a physical book.

This is key, for me. The publishing industry has plenty of lawyers and know what would likely pass muster in the courts or not.

I think they don't ask the question because the feelers they put out tell them answer would go against them, and the whole cookie could crumble, as you say.

I've heard lawyers itching for someone to be charged for breaking the DCMA, because they think the courts would kill it. Publishers apparently don't pursue it because they know it too.

I don't know much, but I tend to put little weight on lobby-influenced, untested legislation.

Riiiigh ... because giving up your entire library and lending out a $100+ device is exactly the same as lending a $7.99 paperback.

Then don't loan your ebooks out or get a second Kindle for loaning or register your friends Kindle on your account or loan out your netbook that also contains your registered ebooks or...

Digital is different, so you can't copy the digital file and loan it out, without express permission from the publisher.

This is getting nutty, just imagine yourself loaning out your Kindle to someone for a set amount of time, say a nanosecond, then imagine the person you loaned it out to doing the same to another, ad infinitum until everyone has touched your Kindle.

Then just slow down time relative to the observer, or just do what you got to do to read the books in the time allotted to you.
