When I was 13 I was undersized. Diane F$%** (14 or 15 and big and tough - you know the type - bad skin - week old eyeliner still on the face) used to follow me around the school and kick my bag or push me. I was too scared to do anything because if I started something I was sure she would beat the crap out of me. This went on for weeks.

One day, I was so sick of it, I thought to hell with it and I pushed her back. I winced and waited for the beating that was sure to come. It didn't; she just walked away and never bothered me again.

I still don't really understand what happened. Maybe she would have been embarrassed if we had got into real biffo, and she had copped a beauty from me. Maybe she needed someone smaller to stand up to her.

The latter, I think. There is a hierarchy in any society, and one thing kids establish, one way or the other, is "pecking order". She pushed you till she got a reaction, then stopped.

the impact of a restraining order does not need an attorney. if they blow off the hearing, an active warrant, not a bench warrant will be issued and the police will come looking. this is NOT a civil matter, it is treated like a criminal matter until at least after the hearing. hte parties involved are questioned by the judge who probably does pretty much nothing but hear restraining orders. an attorney would not be permitted to participate in that part of the procedure. encouraging the expense of an attorney at this stage is frivolous.

I wonder if there's a recognized psychological term for "fear of lawyers"?

But it's a principal factor in schools taking action. There's the fear that "If we take action against this kid, his parents will sue us!" Sometimes it requires a statement from the victim's parents of "If you don't take action. we'll sue you! Talk to your lawyers about which suit they'd rather defend against..."
