I read it that they don't say you can't have a website with Kindle in the title .... Just that you cant have it in the Domain Name .. Altogether different, and to some extent understandable !

Exactly. There's really nothing surprising here. It's a registered trademark, and Amazon is enforcing it in the context that they're allowed to. As you mention, they actually HAVE to enforce it, the law doesn't give them a choice. Even if Amazon wanted to be nice about the domain, they could lose their trademark by choosing not to enforce it.

We in Australia use "Sucks like a Hoover" which is traditionally the most common vacuum cleaner brand.

They don't want Kindle to go the way of Kleenex. I think it is entirely reasonable, and think they went about it in a nice way. But maybe that is just because I see lawyers doing nasty things daily!

How do you refer to something that has a trademarked name if you can't use that name? I think there is more to it than that.

You can use the name to refer to the trademark holder's product. What you can't do is use the trademarked name as a part of your own site or product name.

Eg, it's fine to refer to "Mickey Mouse" when discussing Disney cartoons, but not OK to start a web site called "MickeyMouseCartoons.com".
