@BearMountainBooks: At this point I'm pretty confused about what you did or did not do, and can or cannot do, so I'm going to withdraw all comments made to you and extend my apologies for anything I misunderstood.
Going back to the OP, I think what happened was unethical and that BN (the bookseller in question) should make amends once made aware of the situation.
