There are devices that have no equivalent to "fully off" and are always at, best, in something like a sleep state. Digital watches come first to mind, but there are others.
Strictly speaking, the Kindle has no "Off." It has "Sleep" and "Shutdown" and I'd be willing to argue that either state is in compliance with the spirit of the rule, even if neither state literally meets the letter.
