Recording a performance and then copying that recording will be permitted.

Beyond the idea that what you are actually doing is flipping a switch on your device and recording the perturbations of the air around you. What cannot be recorded is the functioning of the performers mind as signals are sent to the fingers, I mean we can record that, but we have trouble interpreting what those recordings mean, and yet we enjoy interpreting the performances nonetheless.
