Breech of contract, possibly, but not "breech of copyright", especially not if it was an individual, who got the firmware on their own. Only exception would be if some other company was distributing it, without permission.

Taking something copyrighted and owned by someone else without permission is a breech of copyright.

Just read the readme that comes with the firmware, as well as the terms on the site, and not one mention of prohibition of using the firmware on anything but a Cybook. It only restricts you from distributing the firmware, or any other part of their website.
On what I've read on the Foxit firmware, there are loopholes to do it anyway, but would require using other ways to get the firmware on to the device. (which is doable) Last edited by Hellmark; 11-09-2009 at 12:43 PM. |

But if you haven't bought a CyBook, do you have a licence to use the firmware? Isn't the licence a part of the price of the CyBook?
The fact that you can download something doesn't necessarily mean that it's OK to do so. |

It says you're to not modify the software, or disable the licensing or control features. You don't have to modify or disable things, to get it running.
Also, it would be violations of terms of use, and not copyright. There is a technical difference. |

Technically, the issue is, I believe, that each of the Netronix clones has its own boot-loader which will only detect its "own" firmware files as legit reflash files, so you can't reflash a Gen3 with, say, Cool-ER firmware because the Gen3 will simply not recognise the Cool-ER file as a file that it should try to reflash with.
