Wow.
It is not just that the Judge ruled in the Universities favour, but that he did so in a motion for summary judgement. That means he is saying that no properly instructed jury could have possibly found that fair use did not apply. That seems an extremely strong statement. |

When Google copies stuff it is fair use, but when we copy things it violates copyright. Big money wins again.

Sounds like a good ruling to me, although it's limited in scope. From the article:
"The rules of the trust indicate only books in the public domain can have a full text search. Those who own copyright on the other materials would need to give approval before Google can use them." Fair use ought to cover that; it should also cover use by students, faculty and staff. I don't know if Hathi has a plan for the latter, though. |
