Apple v Samsung: Can Look and Feel Be Patented?

The day began with a plea for litigation peace: The judge overseeing the Apple v. Samsung patent trial asked the companies' respective CEOs to get on the phone and try to work out a settlement one last time before the case goes to the jury.

"I see risk here for both sides," said U.S. District Judge Lucy Koh. "I think it's at least worth one more chance. If what you all had wanted is to raise awareness that you have IP on these devices, message delivered... It's time for peace."

Samsung made its most compelling argument yet on why Apple's '381 bounce-back patent shouldn't be consider valid, with an expert witness providing a lengthy look at the Tablecloth application we saw this week. Dr. Andries van Dam, a faculty member at Brown University since 1965, walked the jury through the elements specified in the '381 patent, each of which appeared to be met by the application — and in his opinion, rendering the patent invalid due to prior art.

Is it common in the US to have jury trials of technical issues like patent validity? I think in the UK they would always be judge-only, as the issues of law almost always overwhelm the issues of fact.
I can see why the judge warned both parties to try to come to an agreement, a jury trial on these sorts of issues is a total crap shoot.

Judge Lucy Koh has been going increasingly terse with both Apple and Samsung as the trial continues, and she just let Apple have it after receiving a 75-page briefing. The document covered 22 potential rebuttal witnesses the company might want to call after Samsung finishes presenting its case. With the jury out of the courtroom, Koh laid into Apple, asking why it would present such a lengthy document "when unless you're smoking crack you know these witnesses aren't going to be called!"

Samsung is down to the final minutes of its case, and may be at a real tactical disadvantage because of that. Apple still has more than four hours to present its rebuttal case to Samsung. Judge Koh has said she will absolutely not extend the time allowances, and is willing to cut attorneys off mid-sentence if they go over. The attorneys representing Samsung are keenly aware they're down to the wire; they're shooting questions at their own expert witnesses in a rapid-file staccato.

NEW YORK (AP) — Apple's stock hit a new high Friday after a four-month swoon, as investors looked ahead to the release of a new iPhone and possibly a smaller iPad.

Already the world's most valuable company, Apple Inc. saw its stock hit $648.19 just before closing, before retreating to $648.11. That was up $11.77, or 1.9 percent, from Thursday's close.

Apple has a market value of about $608 billion, almost 50 percent higher than No. 2 Exxon Mobil Corp. at $408 billion.
