This is a non-issue. If you turn off wifi and/or don't plug into computer, you can continue to finish the book after the borrowing period. The book has already been 'returned' but it doesn't cancel out on your device until it's been connected. The library tells me that the same thing holds true for audiobooks through 3m app. If I turn off the wifi on the device before the return date, it will stay on the device until I finish.

Because "free" has nothing to do with a work's copyright status. Free does not equal Public Domain. The copyright holder is still entitled to all the protections that copyright provides regardless if they charge money or give it away for free.

The same here. I have a kobo, my other half has a Kindle. I buy all our books from Amazon and sideload too. As his kindle is also connected to my Amazon, he automatically has access to all those books as well. We're married, in community of goods (not sure what the official term is in English ), so everything that is mine, is his and vice versa.

I wouldn't put those books on my mother's ereader though, in fact, I completely cleared out my H2O before handing it over to her.

Would the question/opinions also apply to audio books? I don't do audio books so do not know what the sale/rent conditions are.

If the audio is sounded via a stereo, then would it be violating the DRM(?) if other people were listening at the same time? A couple of days ago, I see the Audible app being available on the Fire TV; this means anyone turning on the AVR, TV & Fire TV would be able to listen to any books available in "my library".

If the someone was able to enable an ebook reader app on a Fire TV or any other streamer, then a purchased book can be easily read by other people & so violating the DRM!? Or the ebook is on a shared directory on a network harddrive, that book can be read by others with access to the harddrive.

One of the problems with DRM I encountered when starting to use ebooks from the public library, was the my computer's Adobe Id was different from that of the tablet & the library id was different from the tablet. Downloaded the book to the computer, then try to use the tablet to get the book which was not successful as it was a DRM violation......

As for sharing, I do share with some family. I know they don't keep the books and they don't share them. It's no different (IMHO) from my sharing a pBook with them.

The important difference is that when you "share" an ebook, you're creating an additional copy of it. Two copies of the book now exist where there was only one before. Hence copyright law comes into play: does the licence grant you the right to make that copy? Most bookstores licence ebooks "for your personal use only", and hence the answer is "no". You can make as many copies as you want for your personal use, but you can't make copies to give to other people.

...except that Amazon absolutely allows sharing of ebooks with family members.

They even have a program called "family sharing" where I can link my Amazon account with that of a family member and that person can read all of my books and I can read all of theirs.

Yes, I'm well aware of that, but I don't think that's what Jon was talking about. If it's in accordance with the licence terms then there is of course no problem at all. Amazon's licensing terms, though, are very clear:

The license terms that you quoted completely contradict the actual way ebooks/audiobooks/apps are allowed to be used through Amazon, though.

So...either the whole "family library" is against Amazon's license terms, or the license terms are wrong.

The "family library" is in essence a shared account - merging the contents of two accounts into a single pool - isn't it?
