While I know there is a whole lot of "any stick to beat Apple with" going on here, so far I haven't read anything that says that Apple fixed prices. Telling publishers that they can sale for whatever price they want, as long as they don't sale it for less elsewhere isn't exactly fixing prices.

They activly prevented to one Publisher who did not go along with the price fixing scheme from selling in IBooks and encouraged BN to not advertise or display said Publishers books. It was more then the price fixing it was the active harrasment of Random House to get them to fall in line with everyone else that was really insidious (sp).
