Don't mistake opening or closing arguments with actual facts. That's just lawyers trying to sway the judge one way or the other.

Here is a report of the closing arguments from the same source. It seems to suggest that the DOJ failed to prove it's case.

From your post I quoted, you seemed to be confused about what a conspiracy was? I thought the linked article gave a good example of what a (illegal) conspiracy could be. I didn't mean to imply that it was/wasn't what actually happened.

Nope, no confusion on my part what a conspiracy, illegal or no, is. Once again, don't confuse what is said in a lawyer's opening statement with reality in any way, shape or form. It's not uncommon for a lawyer to say that "I'm going to show that the defendant is the meanest SOB in the world who steals candy from babies and kicks cute little dogs" while having zero evidence of any such thing. At the end of the day, it comes down to if they can convince the judge or not.

Actually, a lawyer can be sanctioned for saying something in opening arguments that he cannot prove. You can certainly argue the facts, but you can't make stuff up.

With the launch of the Kindle, Amazon promoted a low baseline price of $9.99 for most e-books.
This sentence opens the second section of the Salon article linked earlier. For Amazon opponents, this is the smoking gun. Unfortunately, it is not and has never been true.

In their original Kindle press release Amazon officially described the $9.99 price point this way:

Quote:
More than 90,000 books are now available in the Kindle Store, including 101 of 112 current New York Times Best Sellers and New Releases, which are $9.99, unless marked otherwise.
The price only applied to certain books, most of which were on the NYT Best Seller list, and generally went up once the books left the list.

The overview in the Salon article may be clear, but it provides that clarity at the expense of accuracy, and a clear explanation on a false foundation does no one any good.

Business as usual Apple.
Two different conspiracies outed in barely over a year.
More to come, now.

Let the apologists' whining begin.

Here is cnet's report:
http://news.cnet.com/8301-1023_3-575...-books-prices/

Quote:
Apple violated antitrust laws in the government's e-book price-fixing case against the computing giant, in a quick decision by the Southern District of New York.
"Without Apple's orchestration of this conspiracy, it would not have succeeded as it did," Judge Denise Cote said in a 160-page opinion issued Wednesday.

Judge Cote said the Justice Department showed in the trial that publishers conspired with each other to eliminate price competition to raise e-book prices and that Apple played a central role in that conspiracy. A trial for damages against Apple will follow, though Apple is sure to appeal the verdict.
So, the hairsplitting got no traction.

I linked to the full ruling in the earlier thread, but this one seems to be getting more traction, so forgive me for posting it here too:

I've dipped in and out (it's 159 pages) and it's absorbing stuff.
