Besides the fact that the cover for The Crystal Cave is using the UK cover (US & UK books have different covers), there is no way HarperCollins would be going exclusive with Amazon. These eBooks are not available at any other publisher. Why is that? Because Amazon makes is very easy to game the system. And guess what? The system has been gamed.

Given all of the evidence in front of you, I fell sorry for those of you not seeing that's right in front of you. I would think you would at least listen to a LEGITIMATE RIGHTS HOLDER saying that the eBooks on Amazon.com are bogus.

Not at all, since the audio books are by Blackstone Audio.

But you're asserting that the ebooks by EOS are legitimate. EOS is now called Harper Voyager, and is part of Harper Collins. Therefore, the ebooks should be on the Harper Collins website if they are legitimate.

Oh, and as to why Harper Collins aren't stamping out this pirate: They have no standing with Amazon to do so. They do not have the rights to the ebooks in the USA. No publisher has. And so it'll need action by the author's estate to get these books taken down.

Actually, it's not legit. You are not buying the eBooks from the rights holder. You are buying the eBooks from someone who illegally put them up on Amazon. Also, knowing they are not legit makes your transaction not legit as well.

Sorry to say, but the books are not legit and your buying them is also not legit.

I can buy those books perfectly legal, even at kobo btw (which I won't do as it has DRM), but it all depends on your frame of reference. What makes you believe that? HarperCollins certainly has the rights to sell the paper version of the books. They could simply be asserting that they also have the ebook rights as well. As far as not having standing, if someone else claiming to be EOS is doing so, then HarperCollins absolutely has legal standing to tell Amazon that it's not an EOS book. They still own the rights to that name.

When I contacted Amazon about the pirated version of some of the Roger Zelazny ebooks, they said they would check on it and it was taken down within a week. I checked with Amazon about these particular books last fall and was told they were legit. Of course, this was a customer service rep and not Amazon legal, so it's hardly authoritarian, but it's pretty obvious that some here don't understand the legalities of the matter.

Once Amazon is made aware of the questionable legal status of an ebook, they are no longer protected by the safe harbor clause. Tying a pirated ebook to a legit audiobook would also increase their legal liability if Lady Stewart's estate decided to sue over the matter.

Rather interestingly, none of the reviews claim that it's a pirated version. Usually, with a questionable ebook, people who care enough to review the book, are the first to point out that it isn't a legit copy. With the Zelazny ebook mentioned above, the reviews were all "This is a pirated copy, don't buy".

Many companies do this all the time--they have the print rights and assert claim on ALL the rights, especially in absence of a counter claim. If this is the case, they would be paying the author's estate under the same terms (most likely--assuming no estate signed different terms or argued against even worse terms). Publishers did this when ebooks became popular and many authors never fussed about it. Those who did, got their rights back and/or negotiated better contracts for the ebook. If no one at the estate is paying attention, they could easily be publishing the book under old contract terms since there has been no argument.

I'm agreeing with JSWolf that the editions in question are being fraudulently published by a third party without payment to the author's estate.

I am not suggesting that the editions in question are really being published by Harper Collins under some kind of rights grab.
