I'm sure it was cheaper to pay him and make him go away than it would have been for them to deal with it. Having their lawyer read the letter probably would have cost them $400.

Amazon has nobody to blame but themselves...they use a video of the device being dropped, what was it, 3ft(?) without harm. We do actually have truth in advertising laws on the books but people are too willing to let the liars, errrr, marketing wonks, ummmm, no just not care, but people don't seem to question anything like this anymore and assume that because The Corporation says it's true or The Corporation are not responsible, then just lives with it.

If a company makes a claim in their ads which are inducements to purchase whatever it is in the ad, then the thing fails to deliver on that claim, the company needs to be held accountable for failing to meet the claim.

I doubt they even took it that far. Trying to decide if they would lose the case would have cost them a lot more than the $400 the guy wanted. The bean counters probably decided it wasn't even worth getting the lawyers involved.

Did you read the article? The guy accidentally dropped a bag containing his Kindle from about 2 feet and the damn thing broke! Amazon wanted to charge him $200 + the broken unit to replace it! Considering the advertisement depicting an unprotected Kindle repeatedly falling 3 feet and bouncing I find it hard to grumble about him asking for $400. This is a case of blatant false advertising. Amazon is no stone and $400 isn't even a scratch.

Shaggy, if you look at Amazon's reply, it was signed by counsel, so it did get as far as the lawyers.
