Just the thought that a publicized suit against a vendor will detail something that will turn away future customers is usually enough to deter the vendor.

It's not a solid point. What makes the physical example significantly different from digital piracy is that:
1) the physical store will have evidence of a crime happening in their store and
2) it would be a person stealing from their store, so at the moment of the theft the store is the owner or the object being stolen.
