Or (commonly) the publisher doesn't have the rights to produce an ebook, and the author (or the author's estate, if they're dead) isn't interested.

...or the estate is in contention, or nobody is really sure who owns the rights, or the author died without heirs and without a will...

Which is all a good argument that copyright should not be transferable, and should die with the author.

I don't mind that. But then what if the author is Disney? Every movie ends with some variation of "Twentieth Century Fox Film Corporation is the author of this motion picture for purpose of copyright and other laws."

So wouldn't authors just create corporations that never die and assign the copyright to them?

(I have a feeling this thread is about to spin out of control.)

Movies are a different creature than ebooks or music. Corporations do tend to own the copyright for movies. Authors tend to own copyrights for books. Music tends to be owned by the composer, though there are many complications.

That's the way it is now. But let's just say that as of today, copyright dies with the author. What would keep Dean Koontz from establishing Dean Koontz, Inc. and then list the corporation as the author of his works?

In that case, there wouldn't be any question as to who owns the rights, because *someone* has to maintain the corporation, or it ceases to exist. If the corporation ceases to exist, and the author is dead, the book is in the public domain.

Done and done. Good job. Some things would essentially never go into the public domain, but I guess that is where we are now.

Who owns the Lennon/McCartney catalog?
Last time I looked it wasn't Lennon/Yoko or McCartney. The guy that bought it has since divorced and died.
So I don't think Lisa Marie has the rights.

The publishing rights to most of the Beatles' biggest hits are owned by one entity, a joint venture between the late Michael Jackson and the music arm of Sony Corp. It's called Sony/ATV, and it also owns the rights to songs written by Bob Dylan, Neil Diamond, Taylor Swift and, oh yes, the Jonas Brothers.

Read through that article if you'd like a headache.

At one time it was Michael Jackson. I remember reading that McCartney has successfully regained the rights to his songs.

Paul McCartney has regained the rights to his music after a long battle dating back decades. The prolific songwriter finally regained the copyright to the Beatles catalog in a private settlement with Sony ATV.
