Getting to the ice cream cone...

[QUOTE==X=;1732573
Getting to the ice cream cone. What happens if you drop the ice cream cone outside the store without even getting so much as a lick. Do you go back to the establishment and demand a new cone.
=X=[/QUOTE]

I don't know. I still remember when I was a kid and came out of the ice cream store (before going vegan of course) and the ice cream fell out of the cone. I was crestfallen, but my mom smiled and said go back in and they'll give you another. And they did. I like it when life is like that.

Sorry to go so totally off topic BUT, when I was a kid maybe 5 or so we had a grocery store next door to our apartment. It was a small ethnic community and everyone knew everyone. My mom sent me there for either milk or bread. Anyway didn't have enough for the milk or bread so I bought an ice cream cone instead.

Worked for me.

Thanks. After reading the karma thread I learned all kinds of stuff. I did a google search for avatars and found that one.

That was a WAY safer time and now days I don't think anyone would allow a 5 yr old to go to the store even next door. Back then the neighbors were always out and new everyone. Old Chicago neighborhood. Everyone out on the porch steps. My aunt, grandparents and mom's best friend lived 2 doors down. Plus I don't know if mom was actually watching me from afar.

Yep. Wasn't a hard decision. Go home for more money or buy ice cream. Plus the store owners were friends of my parents so they probably got a kick out of it.

Well, any time I used to drop my ice cream cone, I responded by kicking a helpless puppy. It made me feel better about myself.

I don't know, maybe it's just me...

It was originally the same way (Fair use) for music and movies until the music/movie mafia criminalized civil law.

I'm curious - is this a distinction you find in US law, and if so, where?

In a later post, you say:

Music and movies also have the same fair use laws, BUT they also have the DMCA which essentially states "...if the originally produced media contains no copy protection, then you have the right to make backups or copy to another medium provided it stays within your possession. If the original media DOES contain copy protection or DRM then you must purchase a new or different medium for a different device, or if your original is lost, stolen or leaves your possession for any reason."

Are you quoting a specific provision of the law, or part of a legal opinion, or is this your own paraphrase of something, and if so, what?
I don't see a response to either of my questions, so I'm just going to say that I do not believe that this is a correct reading of the law. Since the assertions were put in quotes, that implied that it was the DMCA or some other law was being quoted, but a Google search on the quote didn't come up with anything other than the post itself. As far as I can tell, whatever law applies to DVDs & CDs applies with equal effect - or lack of effect - to ebooks.

No, they did not. I certainly didn't get any notification. As a matter of fact, Fictionwise has ceased sending me emails of any kind. Rather rude, considering I bought at least 100 books from them in 2010 (and no, they are not in my spam folder).

However, this disclaimer is on their website, and included in purchase emails, so my bad.
