Yes, but.

It ain't legal here, and the Kindle store at least is selling to the EU using the same base pricing. So either the base pricing is going to jump for the US only (hi, ton of lead bricks!) OR there's going to be some very nasty legal infighting.

Are you sure these books weren't either in the Baen Free Library, or available on the Baen CDs available at The FifthImperium? Of course, I woud argue that there's no good reason for any copyrighted material to be on torrents, unless the author has explicitly released it to be freely redistributable.

Why? In this case Amazon will be distributors. And distributors of news papers or magazines does not set their own price.

The UK courts ruled the Net Book Agreement against the public interest, and thus illegal, in 1997. According to Wikipedia Sweden repealed its own fixed book price agreement law back in 1974. Other countries have different laws, agreements, and regulations on book pricing, of course.

I thought that was only relevant if the shop was a "seller". But maybe there are no distinction between "seller" and "distributor"? Are you saying that a news papers can be sold at any price and you do not have to use the price printed on the paper?

The short answer is "maybe".

The long answer is "Maybe. It depends on the exact provisions of the contract(s) involved, what your local lawmakers (and/or courts as appropriate) have to say about the legality of those provisions, whether or not anybody can be bothered to launch an investigation into whether or not laws are being broken, and whether or not a decision is made that allowing the situation to exist/continue is in the public interest. And all of these things will vary wildly according to your location, so something that is normal business practice in Sweden may be considered shady-but-legal in France and outright criminal in Australia."

At least in the UK, you can get away with far more for periodical pricing than you can books.
