They can.
They will still have a pirated and unsupported version after they upgrade. One that nags them to get legal.

And there are quite a few people who *think* they have a legal OEM license who are about to discover they don't. It happens every time MS does a new release.

I am not for sure yet but I believe that I already have the "real windows 10. I have researched the build number of the RTM of windows 10 which is build 10240 and that is what I have been running ever since July 15th.
