No, it is not a mom and pop. A mom and pop store actually buys their stuff from the manufacturer. Ebay sellers tend to buy closeouts from a retailer.
Unless you bought from an authorized seller of a product that got the product from the manufacturer, then there is no warranty. Period. End of sentence.
Oh and I saw that you put something about defamation and libel in a previous post.
Unless that so called name calling cost you potential earnings, you have no case.

Now I have been known to contact manufacturers for a manual or to ask why isn't this working. Turns out we were using the wrong port to update. But I didn't expect them to give me a new one.

As I have stated previously,
The warranties are only good for the FIRST owner.
If I sell Harry my deep fryer which is less than a year old, that voids the warranty.
It doesn't matter that I bought it new in the box and could put it back in the box to make it look new.
I am not a retailer. I would be a reseller.

Doing a very quick search, the cookware manufacturers don't.
Can you tell me which products?
I think some of them will on bigger ticket items.
Now I know Garmin on their lifetime maps is for the device and owners don't matter.
I know my tablet is not transferable but my TV is. It came with a three year warranty. (Same manufacturer)

But, for the OP, there is no warranty because he didn't buy it at a retailer.

Note from my previous posts, I did not buy the kindle or the sharper image from a thrift store but from a business that buys and sells merchandise.
Oh and on those two, I did have 30 days to return the item to the seller if it failed.
I also knew that if it failed after the 30 days, I was just out the money.
On the Sharper Image even though it wouldn't hold a charge after the first week, it wasn't worth the time to return it. I was just out the $4.

I'm not going to do a long post about warranty laws. They do vary widely between jurisdictions, even within the one country. They are not strictly contractual. Many warranties are governed by and even implied by legislation. Manufacturer's warranties are usually enforceable in this manner, as even in cases where they are not imposed by statute, they involve representation to Consumers and as such are usually enforced according to the typical Consumer protection laws. So Consumers in most Western Countries will have rights against both the retailer and the manufacturer. Often a warrabty will seek to limit its application to only the original purchaser. Whether a warranty in fact applies beyond the original purchaser will depend not only on the terms of the warranty but of the legislation in the particular jurisdiction.

Heck, I could buy an extended warranty from we sell warranties, but that means I have to go through them not the manufacturer to get it fixed.
So Kobo is in no way responsible.

That would be like me telling Amazon they need to give me a new kindle because the physical home button quit working on one I bought secondhand.
Pretty sure the warranty had expired.

Or should I ask Sharper Image to replace their ereader that refuses to hold a charge. I know it had been sitting in a counter for at least 2 years when I bought it.

Now I am going to call west bend to see if they still make the particular Slow Cooker I got super cheap. Note I don't want them to just give it to me.

Come to think of it, it has been 3 months since a company has either called or offered an extended warranty on my car. So yes there are companies that do just that.
I will post the exact name of the company next time I hear from them.
And yes, it starts with warranties.

My point was that some people seem to think that because they just bought a product that the warranty should start then. Or they generally don't know how long a secondhand product has been on a shelf.
Now the only reason I knew how long the sharper image had been setting was I was there the day they put it out for sale. And it was priced way more than I wanted to pay. So I watched and waited.

It depends on the product. I know that Surefire flashlights and Craftsman hand tools are guaranteed for life no matter what. Just present an original item, and the manufacturer will repair or replace it on the spot, no questions asked.

Complex electronic products, on the other hand, tend to have relatively short, non-transferrable warranties, and "open box" items rarely carry any kind of warranty at all. Frankly, the OP is lucky the seller didn't take the money and run.

The fact that Amazon uses PIDs which can identify which Kindle is which, is an accident of their DRM system.

It doesn't have to, it is rather obvious to everybody - 1 that you cannot, in fact, just buy secondhand items and expect the original manufacturer to give you a new warranty.

But Kobo does uniquely identify their devices with a serial number! It's in the firmware, and is used by the Kobo Utilities calibre plugin.
