Because even the guilty have rights under the law, and have a right to make sure they treated fairly and within the law. That's aside from the whole "knowing they are guilty" until proved in court thing. Even if they PLEAD guilty, they deserve representation.

Unless, of course, they are accused of something un-PC, then they apparently have no rights, are to be presumed guilty, and deserve whatever abuse anyone wants to throw at them for the rest of their lives. Apparently.

Even if they hadn't paid him and said nothing he might have gone quietly to protect his reputation. Being fired by B&N is survivable; getting accused, even by implication, isn't.

We don't know if he wasn't offered a severance package. He may have refused to admit guilt and forced B&N's hand. We also don't know how serious this alleged sexual harassment victim is prepared going forward. Multiple cases of "serious misconduct" have been verified. They may have given the execs an ultimatum. Get rid of him or we sue (or go to the press) all of you including Mr Parneros who would have been fired anyway.

While this wasn't handled smoothly on both sides no one will win.

But since he is suing for breach of contract to get the severance, wouldn't the B&N counter have said he refused the severance he now is suing to get?

As for winners, the lawyers on both sides should get plenty of billable hours.

There is now zero tolerance for this type of alleged behavior.

The keyword is alleged. Suspend him until the allegations are proven or dis-proven but firing him and going public? Where I live, we still remember Rachel Marsden. Yep, that swimming coach was harassing and/or date-raping me over dinner while coaching a swim meet in another province. Not to mention several other cases where she was involved in claims of sexual harassment that were later shown to be dubious at best.

In the business world empty words move stocks and markets. Which is why silence is so valuable and NDAs so common.
