Thats pretty stupid, OR the OP is trolling us.
I mean, if I were to go to ebay to search for a Kindle, and I found a used one I would not care if they had metric tons of illegal books on it. Mainly because I could download and copy it myself. Ofcourse, if the OP doesn't actually specify that the books are illegal, the buyer could easily take action (I don't know how, but paypal dispute probably?). Plus the main fear of getting banned by Amazon is a good enough motivation for me to go buy one directly from Amazon itself. Also the fact noted by other people that not only it's used but also the defective first run batch.

What's to say they won't call Amazon and tell they lost the Kindle if they can think of selling illegal books without mentioning it in the listing?

I think the OP mentioned that they were aware that if Amazon didn't get the original K3 back that the OP would be billed for it.

I think the overall greed is what troubles me. Trying to sell a defective unit with illegally obtained books on it in order to maximize profit is abhorrent to me.

I could understand having a book or two on the device to demonstrate functionality but that's about it.

FYI: I wouldn't sell my mp3 player with tunes on it or a computer with any software (other than a legal copy of an OS) on it either.
