Well, this proves that Kobos Customer Care in North America is way better than in Europe (Netherlands or Belgium).

In the past few week I have heard/read serveral complaints about:
  1. missing (wrong) book information; no warning that books can only be read with Kobo apps and not on ereaders.
  2. books that couldn't be downloaded (just like you)

Contacting Kobo Customer service response about:
missing (wrong) book information
* offering no solution
* not offering refund
* not offering a free discount coupon for the inconvenience.

download issues
* not fixing or investigating download issues.
* not offering refund
* not offering a free discount coupon for the inconvenience.

First response of Kobo Customer Care is useless: not addressing the issue, or denying the issue. In short: not investigating the issue.

Customers must be persistent to Kobo to fix their issues.
Second Kobo respond:
* same answer as first response (no refund, no fix for download issues)
* note: in some cases Kobo offered a 20%-30% discount code; but did not refund the purchased book or fix download issues.

Contacting Kobo for a third time:
* finally they offered a refund
* not offering a discount coupon for the inconvenience.

For my part, I must admit they did not offer a return of the coupon; I asked for it and the reply was that they wouldn't give me one, to which I asked them to "please explain why you won't return my promo code seeing as I wasted it on a book I can't download?" They relented after that.

All my experiences with Kobo CS (especially compared to Amazon's CS) have been less than ideal, chat or email. In my opinion, chat is just (mercifully) shorter. What I've found to be helpful is being firm and persistent; my emails/chats with them always read like arguments

Mine sometimes do. But I've found the last few chats the reps have offered replacement coupon codes without prompting. Their customer service has gotten much better than the days of "all sales are final."
