I see the fact that certain books were pulled by the Agency 5 like the restaurant mentioned earlier. You might pay in advance for today Special, but when you go back the ingredients for that special are not available, so you cannot have that special. Granted, you should get your money back, or something else in its place, but if the ingredients cannot be had (out of season or whatever) then they cannot be had. you should have eaten the Special when it was offered. The waiter even told you the Special might not be available later, but you insisted on waiting.

There is no gray areas here. FW spells everything out clearly. The OP CHOSE not to download his books that were immediately available.

Stores sometimes allow lay-aways for clothes, but they give you a time limit on them to be picked up, and if not purchased, they go back out on the floor for someone who actually WANTS them.

You can try to nitpick away as far as language used or what you think is the right thing, but the OP blew it by not downloading right away as he was instructed to do so by FW. It was his error, NOT FW.

The bottom line is that he neglected to fulfill HIS personal responsibility & is now trying to blame anyone & everyone for HIS mistakes.

Hmmm...I read the original post to say that his remaining Micropay balance disappeared.

But if what he meant was that the micropay earned for the book in question disappeared, then I'm beginning to lean toward Graham's thoughts that the book price was refunded (and micropay refunded).

For what it's worth, up until April 1, Fictionwise told you:

NOTICE: You should download your purchases as soon as possible. Fictionwise will maintain your purchases on your bookshelf for at least three months, and longer if we can, but that is not guaranteed. Make sure you back up your files.

Now they say:

I don't think you understand yet, they *don't* provide a place for you to store the book. The only books Fictionwise stores themselves are their multiformat books. For all DRM books they sell you access to the book stored *somewhere else* that the publisher chooses. They have no control over that somewhere else.

The bookshelf provides you a link to that somewhere else, not a storage place for the actual file. Fictionwise has no control over that somewhere else, and if the publisher has pulled the book there is nothing they can do.

A couple of books I pre-ordered prior to April 1, but that were released after April 1 were not there when I went to download them. However I simply emailed FW and got a refund for the purchase price. I even made out on the deal, because they were both 100% rebate books and I had already spent the rebate money, and they didn't demand it back or remove access to the other books I had purchased. However this case is different because I never had a chance to download the books before they were pulled.

FW has been destroyed due to this agency crap, but they are reasonable albeit slow to deal with. They even refunded my buywise membership with 4.5 years left, in full, and again I had gotten 100% rebate on it that I had already spent.

From what you've said it sounds as if FW has refunded your money, even after at least 6 months, and taken away the micropay you got for buying the book. What more do you expect from them?

I've gone from loving Fictionwise to hating them. There is simply no reason tom give them my business any more. With agency pricing we shouldn't need the buy wise club. Now they sell way over priced, if they have the book at all.

They also have become completely unresponsive to their customers....and they can't blame that on anybody else.

not fw fault... but still annoying

I almost lost a few books this way, but managed to download them just in time. I used to download books as I bought them but got lazy when I had my iPod Touch. It did no good to save a copy on my computer when I could only add them to the iPod via wireless download, so I got lazy.

This whole deal with the Agency 5 has left me feeling sour about the ebook market. I have been reading ebooks from ereader (originally peanutpress) and fictionwise since 2001 and never had any issues. Now I find myself having to choose between sticking with a store whose future seems suspect and switching to... something else. I'm leaning toward amazon, since their kindle software is available on so many devices (using my blackberry now but will probably switch to android in a few years) but I am becoming leary of putting my trust in any of these companies.

When I bought my last books from Fictionwise a few months ago, they applied all of my remaining Micropay balance toward that purchase without me asking them to. (It was probably less than $10.) I probably wouldn't have even noticed except that I had read a post from someone else here at MR describing the same thing. I wonder if that's what happened to the OP? His purchase actually used his Micropay balance, and then, since he didn't download, both the book AND the Micropay money seem to be gone?

His purchase was 9 months or so ago. As noted above, the simplest explanation for the books disappearing from his bookshelf along with the Micropay rebate received for those books is that Fictionwise have processed a refund (which would take a few days to show up on his statement).

We've had a lot of ire directed at Fictionwise this year, and it's usually turned out that they've done their best to act in good faith, with what gives the impression of a dwindling staff and a parent company (B&N) chipping away at them and slowly closing them down. I suspect morale is not so good there.

Precisely! I feel very sorry for the employees of FW, they are getting the shaft just as badly as we are. Besides their proprietary ebooks, the way they have treated what was once a very good CS oriented company like FW is why I never intend to do any business with them.

That notice started happening sometime between May and August of 2007; May 07 and earlier contained no notice of time limits on downloads.
