Amazon permits it. B&N will only sell them on B&N.com (they have quite a few if you go looking) or through special order. To the best of my knowledge they still don't regularly stock APub books in their brick & mortar stores by their own choice.

@AnemicOak. Thanks for the information. I wasn't aware B&N was going even this far. Not that I personally use B&N. It seems to me that they are not long for this world, which is a shame, even though they have been and remain their own worst enemy.
