It's the same here in New York. The requirement, however, is for "hands-free" use of a phone, and you don't necessarily need a headset for that since you can also use the speakerphone function which is a feature of many phones. Moreover, there are many who do not want to move around with a headset attached, so it seems to me that for a phone to make it you must be able to answer a call by just picking it up.

I have a Bluetooth earpiece for when I'm driving--no hands free law in PA, but my car has a manual transmission so I need both hands to drive! I just don't know who's calling me, that's all.

I don't agree. People may own headsets (I own three, one being a stereo model), but they do not keep them on most of the day. If you are walking around your house or outside, and your phone rings you must be able to answer it by picking up the instrument, as it is much too cumbersome to insert a headset after the phone starts ringing. Or are you suggesting that people with headsets wear them all the time? My point is not that people don't own headsets but that they do not keep them in their ear all the time, and that that greatly cripples the Readius as a phone.

actually i see quite a lot of people walking around with bluetooth headsets on their ears, who seem to wear them much of the time, if not all the time. if they get a call, they just touch the headset. to be honest, i suspect that some of them do it because they think it makes them look important or even (pfff...) cool (and i snicker at those ones), but some of them clearly use them for convenience.

Well, I wouldn't call it useless but perhaps useless to you. That resolution is the standard for Windows Mobile PDA's and lots of folks read eBooks on those devices. However, I would agree that it is not up to the current standards for 5" devices.
