I would still give the guy negative feedback and make sure people know he was selling something that was stolen. He could very well try and sell it again on EBay.

I had my first K3 stolen in December when I had lunch in a London pub. I got in touch with Amazon and they blacklisted it. I wondered how useful it could be to the thief, but I was thinking of someone pinching it for their own use. But stolen goods of all sorts get flogged on. I should have realised...

The situation has been resolved for the OP, but not for the original owner of the Kindle. I would have had the police go with me to meet the guy and let him explain the Amazon situation to them.
