I thought about that, but it didn't seem completely clear to me. Limited public figure is more likely. But again, this highlights the issue that the statements made and the controversy are about the book, not personal to the author.

I also question whether calling something pornography in this day and age is actually defamatory. The same question has been arising over the past few years as to whether calling someone gay is defamatory.

I'm still not seeing how the author was defamed. You can't defame a book.

I'm not a self-published author. My books are published though an actual publisher and I get paid royalties.

Ebooks like the ones here at Mobileread, or Project Gutenberg, or Baen's free library, don't give anyone control over your reading. You can download the book, install it on any device you want, convert it to another format if you care to, send it to a friend when you're done with it. (That last is potentially breaking copyright, depending on the terms of the book; Baen & Gutenberg are fine with sharing them around, and most of the ones here are public domain.)

The big ebookstores that publish the "Big 6" publishers have worked hard to convince people that ebooks are always locked to the store or the device, or that customers should expect someone to be logging their reading habits. It's not true.
And I will state, honestly, that half my decision stems from just plain liking the feel of a real book and not merely from my own experiences with Amazon or the fact that they went into people's Kindles and took away copies of "1984" without bothering to tell anyone. If I have the book in my home, they can't do that...at least, not yet. Give the GOP time, tho'...

Okay, reading through this thread has been quite an experience...and I'm still a bit raw from it. But I've noticed a great many of the posters made assumptions that need to be cleared up.

1. As I noted just a couple posts earlier, I am NOT a self-published author. All four of my titles have been published through an actual publishing company. It's not Harper Collins or Random House, not by any stretch of the imagination, but I get paid royalties on all books sold...and those books are sold not only through Amazon. BUT -- Amazon sells 65-70% of them (if not more; I won't know till next week, when 2010's sales figures are posted).

2. Amazon may have the right to sell my books or not, as they so wish, but I also have the right to scream about them dumping my books without a valid explanation. If they didn't like the titles, they shouldn't have accepted the books or sold them for years. I didn't hide anything, and that's my name on the covers. Dumping my books like this suggests there is something wrong with them, and like any parent would, I'd defending my babies. And I will do so as loudly and as obnoxiously as I choose.

3. Mine were not the only books Amazon dumped for no understandable reason. They've done this to hundreds, if not thousands, and not just in the US. So I'm not the only person screaming about it.

4. My books do NOT promote rape. They show how destructive and vicious it is. Don't judge my books by their titles; it only exposes your own ignorance.

5. I AM using this to my advantage with sales. I've actually worked up new banners with links to put up on various blogs, banners like this --

Artists are public figures as far as statements about their artwork go as they are considered to have deliberately put themselves in the public view by offering the work to the public.

I have noticed a slight uptick in B&N's sales (you have to work it out via the sales ranking they post in the book's info) but nothing spectacular, yet. And the sales of my other books -- "Bobby Carapisi" and "Porno Manifesto" are up slightly, even on Amazon.

BTW, the publisher tells me "Nook" is not restricted to area or country, so you should be able to buy HTRASG online through them if you can get a Nook shipped to Australia (which might cost as much as the device, in shipping and duties)...but it'd be interesting to know if that's true or if they're just making an assumption.

We can still sue for damages, but the bar IS a lot higher.

I just realized, I now think of myself as a public personality. That's a weird realization. I've always tried to lead such a low-key life.

They're making assumptions. Nooks are made for a USA audience, as the company is American. I don't believe it's changed.
