As would I, I would definitively advise her to do that if she were to stay longer but she returns in March so I doubt this sort of legal action would be of much use...

It really pisses me off knowing that this guy gets away with these tricks and probably has done so several times on other people who were only passing by.

Regarding the reader I believe she's going to give it a shot at "returning" it to Targets for store credit and buy the 700 there. Maybe that will work..

I still say, send her to target to try and return her "gift". Either than, or be happy with the 505. Or sell it on ebay.

Unfortunately it is her word against the stores as far as them tell her they were giving here a 700 and they put a 505 in the bag.

A couple of things to consider though...

Inform the local "Better Business Bureau"?

Investigate if there's a "Small Claims" facility? (UK equivalent would allow a claim without running up significant costs and a judge could view the policy as not appying if it was a "bait & switch".)

Was it paid for via a Credit Card - if so, go to them for advise/refund.

Was it advertising, etc, via Disney newletters/programs, etc? If so, contact them.

If there's an in-house Disney newsletter, write an article for that describing the experience!

Trouble is, it's her word against his, and I don't think that any court would convict on that basis - there will (quite rightly) always be a presumption of innocence. If what was sold was a PRS-505 in a box clearly marked as such, with a picture of the PRS-505 on it, then a court would probably take the view that it's the responsibility of the customer to ensure that they are buying what they actually want. caveat emptor.

As a few other posters have suggested, I seriously suggest you tell her to look into what her credit card company can do. She was scammed, they refuse to refund her purchase AND they opened the box which would further complicate any kind of return as new.

I know it is a huge hassle, but contact everyone possibly. Call Sony and tell them what happened, if the store is a chain, call their corporate office, call the city and see what they can do, etc...

When she brings it home, perhaps you could sell it at cost to someone local (they can avoid customs and what not) and then perhaps a MobileRead member could help by picking up a 700 and sending it to you? Dunno if that would be at all feasible for you... -shrug- I am sorry to hear about that happening to you.

I would have sworn this was an electronics/photography shop in NYC from the story. Hard to believe that happened down there at an affilliated store.

I hope you find some sort of resolution to this.

About the store: they are not affiliated with Disney, they told her they were but they are not part of Disney's roster. Furthermore, the manager claimed that he never said she was getting the Cast Member discount and that it was his word against hers. Again same case scenario regarding the unpacking of the Reader.

She paid with her debit card or check card, I'm not sure what's the appropiate translation... The one where your employer deposits your paycheck.

She's going to Target tomorrow so I'll let you know how things develop...

Thumbs up Finally...

Hi everybody!

I am posting to tell you all about the last chapter on this journey we have shared ever since I started this thread.

To make a really long story short: she finally was able to change the PRS 505 for the PRS 700. She went to a Sony Style Store and they charged her some 60 bucks extra for being unpacked... I know I ended up paying A LOT more for this unit than I ever thought was going to but at least it's an end to this eternal (or so it seemed) quest.

As for the crooks on that store, we plan on writing Disney about it so that at least Cast Members are warned against getting near that place.

I would like to thank each and every single one of you who took an interest in my story and tried to help out as much as you could. I really appreciate it
