The books didn't show up on the device initially, then they showed up later. It's not hard to imagine, and your calling it an 'inconsistency' and implying that it makes the OP looks like a liar, is laughable.
They sent me a refurbished unit instead of a new one (there were many fingerprints on the unit, diverse books from the previous user were not removed, usb plug is visibly well worn etc...)
You don't mention it, but was the protective sheet on the screen?
And what exactly does the USB plug look like? I mean, looking at the cable I use everyday with my Kobo devices, which I think is the one that came with the Forma, I don't see any damage one either of the plugs. Or did you mean the USB socket on the device? Again, looking at my Kobo devices, going back to the Touch, I don't see any damage. Or any wear at all. The printing on the Touch is about the only noticeable difference
As an FYI. I just did a factory reset of a Kobo and used that hack.
This is on a Clara HD and the factory reset took it to 4.7.10733
I've yet to upgrade the f/w, or even connect it to wifi.
My Books / Authors lists 4 pages of Authors (38 Authors) including some that are Chinese or Japanese. Each author claims to have 1 book, but selecting that author shows no books. There are no collections or books shown.
Connecting to WiFi results inj an upgrade being downloaded. Post installation I'm now at 4.23.15548 with still 38 Authors listed and no books. Subsequent syncs check for an upgrade and then fail due to lack of kobo account.

I think it's safe to say that the real issue here is the factory reset partition contains extra data.
I just pulled the fs.tgz and db.tgz from the recovery partition of my Clara HD. During the full factory reset, the fs.tgz is unpacked to the root partition of the device, and the db.tgz is unpacked to the books partition. I can see the files you list above. And looking in the database that is included, I can see those books, plus some recommendations. The database also has a user in it that includes "demo" and "test" in the email address.
This looks like data taken from test, or maybe it is used for a demo mode mode. Some of the books @Gadgetguy listed are in the database. But, as the Forma and Clara HD images are different firmware, Kobo have probably changed the book choice for whatever these are being used for.
From that, if you do a factory reset, you will see these books if you don't go through the proper setup. They probably get deleted as part of the setup. Along with the database and related files.
And what I had forgotten, was that when I got the Forma, I plugged it in and took a copy of everything on the books partition. Looking at that, I can see the series that @Gadgetguy mentioned in the database. Did @Gadgetguy do the setup properly, or hacked the database? Doing the latter would probably explain the discrepancies when using the device.

You don't mention it, but was the protective sheet on the screen?
And what exactly does the USB plug look like? I mean, looking at the cable I use everyday with my Kobo devices, which I think is the one that came with the Forma, I don't see any damage one either of the plugs. Or did you mean the USB socket on the device? Again, looking at my Kobo devices, going back to the Touch, I don't see any damage. Or any wear at all. The printing on the Touch is about the only noticeable difference
Yes, there was a protective sheet. There were also numerous fingerprints around the up / down buttons (which I have removed with alcohol).
The USB plug is lose - when I plug the cable in it gets dislodged if the cable experiences the slightest touch (and so disconnects).
I have many many USB devices and never saw a unit where USB was so lose on day 1. I did see several where hundreds (or in case of my kids, sometimes dozens of careless) plug / unplug operations lead to to the kind of lose connection my Kobo had from day 1.
But maybe
a. fingerprints are normal
b. lose plug just indicates they use cheap parts and
c. you already found the reason for the "ghost" books

No, I would not expect that first level support, or even second level support would know about this. It is not a normal for these books to be seen. Most people would never see them as they would just do the setup over WiFi, and the files would disappear.

Which basically means you put it into a state that Kobo doesn't support. I would have expected that Kobo would quickly have asked you to do a factory reset and do the setup properly. And until you did, they can't really support you.

And that is actually a comment on how unlikely it is that someone would see those books. None of use who have been playing with these devices for years knew they were there. Otherwise, we would have simply said to do the factory reset.

To me, the protective sheet being strongly suggests it isn't a refurb. Though the fingerprints suggest the box was opened. It could have been a quality control to check everything was in the box. Or a customs check, though you list yourself as in Canada, so that isn't likely.

I have many many USB devices and never saw a unit where USB was so lose on day 1. I did see several where hundreds (or in case of my kids, sometimes dozens of careless) plug / unplug operations lead to to the kind of lose connection my Kobo had from day 1.
Is this with the reversible cable that Kobo supplies? If so, I don't find it anywhere near as secure as most normal cables. But, it is so convenient, that I don't care, I am just careful. And my wife using one means a lot less swearing at me from her. When Kobo makes an ereader with a USBC socket, she will be getting a new ereader. And probably a second for her mother.

CUSTOMS in the country I currently reside in often open boxes and handle items. And sometimes - sometimes, mind you - there are reported incidents of items mysteriously vanishing.
This Statement is Not TRUE MG : Then there’s the oddity of your claim (see other post) that the books weren’t on the Forma at first. Even though it’s quite impossible for this to be the case if you are right that you did not sideload them. Literally the first thing that would happen upon (even faking) the registration is an import of the books on the device.
I have Often tried to DL ebooks that Dont show up for Weeks Later. As I can Only DL when I near Wifi. At different points I was doing just that when my electric would go down or my cable. Several of those times it was Weeks before they get to my device. To try to redownload them was impossible.
I saying that the OP got a Used Device that was Not taken back to Factory & when it was turned on & close to a Wifi it Then DL the ebooks.

Sideloaded books are not affected by logging out of a device, and would thus still be on the Kobo when it was re-registered either by a legitimate account (new or old) or by a hacked method to get past the registration screen.
Purchased books are tied to a specific account and are affected even by a simple log out. You would have to re-download them. As GadgetGuy used a hacked method to get past the registration screen this is not what could have occurred since as far as the Kobo servers are concerned the device is still not registered.
Your examples, books not downloading because of a lack of wifi and/or power would thus be negated because the books are 1) tied to your ACCOUNT not the device, and 2) are not on the device to be processed, and in OP's case never would be.

Agree BUT You Fail to See is the E-Books ARE Connected to the Device Since the Device IS Still Connected to the Account of the Person that sent it to Kobo to begin with! Not the person that Kobo sent it to! DUH!

Except they weren’t. In GadgetGuys case the phantom books were from the hacked registration method he used. Which is why they weren’t behaving as actual books.
The device wasn’t still connected to a previous account nor is it actually likely that it ever was registered before GadgetGuy got it. This is all covered in this thread and in specific detail in one of David’s posts here.
Had GadgetGuy waited until the kobo servers were up and running he’d never have had his phantom book issue.

I have received the return instructions last night and returned the unit today. Kobo CSR said it takes 2-3 weeks from here. Based on past "commitments" related to how long things take - it may well take much longer...
