Well they want me to Return the Refurbished one Back & they will then Send the New PW3... I tried to Stop the shipment I contacted them ASAP as soon as I saw the change. Wasn't quick enough...suppose to get here Friday. sheesh What a Mess!

There are several reasons I Don't buy Refurbs 1 Don't know how the device was treated. 2 Problems don't always show up till much later 3 then they Blame me for the problem!!
New one I know its Not been Dropped or some one Cleaned the Screen Wrong! Any Damage is Factory or Bad Parts. Not Miss handling.

I wonder if the chat transcripts form legally binding contracts? They are, in effect, written agreements, so they should be binding. Would be interesting to know what a legal person had to say about this.

"Legally binding" is largely irrelevant. My PaperWhite cost me $89 on sale. It is not reasonable to sue Amazon and try to force them to give me a new one rather than a refurb. How much would that cost in legal fees and time? Ridiculously more than the PaperWhite itself. It's not sound financial judgement to go down that road.

Here in the USA our states have attorney generals. Kind of like a state legal department that can sometimes help consumers. I don't know if you have an equivalent in the UK. You could report Amazons actions as fraud and see if the attorney general would go after them. You wouldn't have to pay for that.

The easiest course of action is just to accept your losses on the PaperWhite. Then place a few posts on social media describing your ordeal to get the Social Justice Warriors fired up, and hope they start posting on FaceBook, Twitter, Yelp, and all those places they like to waste their unlimited time on when they get righteously offended. Maybe their viral posts will get Amazon's attention.

haertig I agree with what you said, just want to add ... IF some one would go the "Legal" route they can loose More than the PW3 cost. Amazon Can Block E-Books Movies & Music that's been purchased thru them & Close the Account! That may not be Legal but lets face it Amazon Does have the Power to do it.

I been thinking of using the Refurbished as Trade in & pay the difference for a New PW3 with the bigger storage! Trade in Ends March 30th!

I've read of others having an issue with a rather new Kindle and Amazon wanting to send a refurbished when it should have sent a new one.

Though, I had a computer monitor that decided to go wrong after maybe about 2-years and and they replaced it with a refurbished monitor. You'd have never known it was refurbished.

Well it arrived today.... So I decided to check it out before I contacted Amazon. They sent me a Defective Device!!! Lower Right has been held so firmly the thing around the light is mushed the area looks dark gray...light is working but cant reflect upwards into a clear cone. There are several bright light spots on the screen. UGH here we go again!

haertig ... have you received yours yet?

Why not just do the trade-in? I reckon this would qualify for the $69.99 PW3 SO promo. Then add another $35 trade-in gift card and your net price is just $35.

These are the only two questions anyway:

Does the Kindle work perfectly and hold a charge?
Is the display cracked?

If Amazon's willing to send it in that condition as replacement, I think it's well within reason for you to answer yes to both questions.

Not necessarily. A Kindle in any condition automatically qualifies for a $69.99 PW3 SO. If your Kindle's defective, they give you $5. If it's working, it's $35 additional credit for any of the Paperwhites and I think $20 for the newer generation Kindles (Basic/Touch).

That said, good that they're sending a new one.

No. I actually just now dropped the old one off at the UPS Store about an hour ago.

After reading of your frustrations of being told you'd receive a new one, then having a refurb one shipped (defective at that!), I took extra precautions.

Attached to my old Kindle is a copy of my entire chat with the Amazon rep, with the parts where I was told I'd receive a NEW one (in mine can't be fixed) highlighted.

Will that make a difference? Who knows, but it was the best I could come up with to nip any slight of hand on Amazon's part early in the game.

I'll report back on what I receive. I'm thinking the earliest I could potentially see a Kindle back in my hands would be next Friday the 16th, and even that's just a best case guess.

In the meantime, I'm back to using my old Nook Simple Touch for a while. Not a bad thing - it's still a decent device. I did a factory reset on the Kindle to wipe out whatever I had put on there before handing it over to UPS. And got a "proof of drop-off" receipt at the UPS Store.

p.s. - I also took a photo of the "Device Info" from my old Kindle, showing the serial number and network MAC Address. In case they want to tell me they are returning mine, but slip in somebody else's refurb anyway. Amazon can probably spoof the serial number easily, but maybe not the MAC address (which is unique). Am I paranoid? Yeah, probably so.

Nah, you can spoof the MAC address (iirc, not all that unique either although chances of collission are low). I remember having my wifi router spoof the MAC address of my PC so the cable modem would play nice with it. That said, I reckon Amazon wouldn't bother spoofing either serial number or MAC address.
